The notion of form-of-life refers to a living dimension that has overthrown the structures of power in which humans are supposedly destined to live, disclosing the possibility of a new understanding of political and legal life. By placing the 'form-of-life' in the context of contemporary philosophy, this book re-imagines anew some of the basic categories of human socialities - such as work, rights, obligation, property, and use. A century after the publication of Evgeny Pashukanis's pivotal book General Theory of Law and Marxism, this collection presents a comprehensive account and analysis of his key concept of legal form. Evgeny Pashukanis's General Theory, born amidst the fervour of the first socialist revolution, remains still a crucial reference point in Marxist theories of the law and critical legal theory. Its theoretical depth paved the way for new understandings of the relationship between Marxism and the law. Its crucial virtue continues (...) to be, even after a century, the ability to articulate epochal concerns in the context of a socialist revolution that turned hitherto theoretical problems into dilemmas of practice. This book returns to Pashukanis's main concept: 'legal form'. Through this jurisprudential category Pashukanis aimed to grasp the dependence of the law on the economy, and at the same time, to enquire into the degree to which the law preserves its autonomy from economic relations. In other words, the legal form as a concept conveys both the law's dependence on the economic sphere of exchange and its greatest inherent specificity: the way it translates economic relations into its proper language and set of legal/ideological constructs. The contributions to this volume provide a range of perspectives on how the concept of legal form has been developed and reinterpreted. As Professor of Theoretical Medicine for Surgeons at Padua University between 1824 and 1849, Giacomini achieved a position of great academic professionalism and prestige, not only in Padua, but throughout Italy and Europe. His fundamental medical thesis became part of the established field of medical practise that existed into the first decades of the 19th century. This thesis, derived directly from a vitalistic concept of biological phenomena, was based on the existence of a 'life force' that is distinct from (...) the forces of physical-chemistry, having its own specific laws, contrary to those of physical-chemistry. Using this concept Giacomini was able to distinguish two causes of death: mechanical illness and dynamic illness. The nosographic and therapeutic beliefs of Giacomini were based on his distinction between the 'mechanical' or 'dynamic' effects of drugs. Giacomini's medical philosophy is the result of an interweaving of scientific theories and metaphysical ideas. The merits and limits of this philosophy must be analysed in the light of modern epistemology to explain why Giacomini was unable to develop fully clinical anatomy. (shrink)

An outdated geography supplies the bond among the thirty‐one articles in Sur les traces des Cassini. In the seventeenth century, when the Italians Gian Domenico Cassini and his nephew Giacomo Filippo Maraldi were born in Perinaldo, north of Genoa, their birthplace belonged to the County of Nice. Hence the rationale of building a set of papers on astronomy in the south of France around Cassini I and his family, which for four generations ran the Royal Observatory in Paris.Over (...) half the articles concern the Cassinis, mostly Cassini I and his great‐great‐grandson and namesake Cassini IV. There was also a Cassini V, Henri de Cassini, who countered the family genius and stamina by preferring botany and dying early, of the same outbreak of cholera that took the life of Sadi Carnot, without having created Cassini VI. He had already entered the Academy of Sciences with a push from his father. “I dare to beg of you [Cassini IV wrote to his fellow academician A. M. Ampère] to consider whether this unique situation in the history of letters, [a family's] devotion to the sciences for five successive generations and 170 years, ought not add some weight to the scientific credentials of my son.” It is hard to refuse the children of important alumni.The portion of Traces dealing more directly with astronomy in the south of France gets off to a distant start. Pytheas of Marseilles, who lived about 350 b.c., sailed to the Orkneys and the Baltic and earned himself the reputation of a liar back home for his stories of midnight suns and frozen lakes. He measured the latitude of Marseilles, the obliquity of the ecliptic, and the size of the earth. Ptolemy praised him. Strabo did not: “Pytheas lied about everything and covered it up with his knowledge of astronomy and numbers.”No traces worth following up were laid down for just under two thousand years. Then, in 1580, Nicolas Fabri de Peiresc first saw the light of day. He lived in Italy for four years as a very young man, deepening his knowledge of astronomy and human nature and meeting the main future actors in the Galileo affair: Galileo himself, Bellarmine, and Matteo Barberini . At his center in Aix‐la‐Provence, Peiresc made many useful astronomical observations, some in collaboration with Pierre Gassendi. He died in harness, worrying about the change of the obliquity since the days of Pytheas.There follow articles on Provençal astronomers who determined longitude and latitude at sea, on neglected observers in Languedoc who assisted the cause of the Enlightenment, and on modern observatories in the south of France. The political circumstances after the defeat of 1870–1871 favored decentralization of astronomy away from the Paris Observatory. In Italy, too, recent political events—the unification of 1870—made a restructuring of astronomical institutions desirable and possible. But whereas France had too few observatories, Italy had too many. Georges Rayet and Pietro Tacchini, both astrophysicists, compared the circumstances in their countries and made mutually reinforcing proposals to their colleagues and governments. Their respective proposals, most of which were enacted, called for reassigning some Italian observatories to meteorological work, building new observatories in Besançon, Bordeaux, and Lyon, and refurbishing older ones at Marseilles and Toulouse. Once again, as in the days of Cassini I, Italy made a decisive contribution to the practice of astronomy in France.Sur les traces des Cassini mixes slight and weighty work, admits antiquarian and broader approaches, offers new documentation, displays pertinent illustrations, and does it all at a high level of scholarship. One important distinction in the debate over the nature of epistemic justification is the one between propositional and doxastic justification. Roughly, while doxastic justification is a property of beliefs, propositional justification is a property of propositions. On a rather common view, which accounts for doxastic justification in terms of propositional justification plus the so-called ‘basing relation’, propositional justification is seen as the prior notion, and doxastic justification is explained in terms of it. According to the opposing view, the direction of (...) explanation needs to be reversed, and doxastic justification should be seen as primary. I distinguish between two notions of priority, and I argue that they give different verdicts with respect to the issue of which notion of justification comes first. The lesson may be taken to be that propositional and doxastic justification are in a relation of intertwinement. (shrink)

The question of the basis of human equality has recently gained increasing attention. However, much of the literature has focused on whether persons—understood as fully competent adults—have equal moral status, while relatively less attention has been devoted to the analysis of what grounds the equal moral status of those human beings who are not fully competent adults. This paper contributes to this debate by addressing the question of the equality of moral status between adults and children. Specifically, this paper has (...) three aims. First, it provides a conceptual map of this complex issue. Second, it argues that the challenges that have been raised against standard accounts of persons’ equal moral status are even more forceful when applied to the question of adults and children’s moral equality. Finally, it examines what a commitment to adults and children’s moral _inequality_ entails and what it does not, thereby showing that the justificatory role of the principle of moral equality is not as far-reaching as commonly assumed. This contribution reflects on the current role of ontologies in terminology research and practice and their future role, especially with a view to the creation of fully digital terminographic resources. The very notion of (domain) ontology, its concept and term, is discussed, highlighting metaterminological differences and substantial ambiguities arising from the interdisciplinary contact between Ontology Engineering and Terminology. Major challenges in ontology building, e.g. subjectivity, are mentioned, also with respect to the distinction between realist and non-realist ontologies and their relevance (...) in Terminology. In addition, this contribution presents some examples of terminology resources with a distinct ontological component, showing a diversity of approaches depending on the purpose of the resource and its scope. In this context, more specific topics are addressed, such as the acquisition of ontological data and suitable formats and models for representing domain knowledge. The contribution ends with a vision of the integration of complex concept systems such as ontologies in future terminology work: here, the development of models based on terminology-specific requirements and typical users will be fundamental. This paper develops a novel theory of the meaning of moral equality. This theory has two original and significant implications: first, it shows—contra what is commonly held in the literature—that adults and children are not always each other’s equals; rather, the former are sometimes inferior and sometimes superior to the latter, depending on the interest at stake. Second, it reveals that human beings’ comparative moral status changes across time, and what matters is that they are each other’s equals at simultaneous (...) segments of their lives. (shrink)

When we witness a great actor, musician, or sportsperson performing, we share something of their experience. Only recently has it become clear just how this sharing of experience is realised within the human brain. 'Mirrors in the brain' provides an accessible overview of mirror neurons, written by the man who first discovered them.

This study investigates the risk and return characteristics of impact investing in the public equity market. We use a unique hand-collected dataset of 50 US listed firms whose product (or service) addresses at least one of the global social and environmental challenges, as defined by the United Nations Social Development Goals (SDGs). We designate such firms Impact Firms, and we compare their financial performance to a matched sample of Non-Impact Firms in the time span 2002–2019. Our results show that Impact (...) and Non-Impact Firms have similar level of financial performance and both volatility and systemic risk over the entire sample period. At the same time, Impact Firms show a slightly lower negative skewness of the returns over the entire sample period, but not during crisis periods. However, compared to matched Non-Impact Firms, Impact Firms outperform during periods of market crisis, generating a valuable dampening of downside risk. (shrink)

The philosophy of language of Robert Brandom is based on a theoretical structure composed of three main elements: the normative analysis of linguistic practices, the inferential characterization of conceptual contents and the expressive articulation of the relations between the former two. Normative pragmatics aims to explain how linguistic practices are sufficient to confer contentful states in those who engage in them. Inferential semantics provides a theory of such pragmatic significances in terms of the inferential relations that articulate conceptual contents. Rational (...) expressivism is the thesis that concept application is essentially a process of turning something that can only be done into something that can also be said. Such a threefold structure is the core of normative inferentialism. This book is a concise, selfcontained and comprehensive presentation of this philosophical enterprise. It guides the reader through the analysis of Brandom’s imposing theoretical apparatus, the discovery of the roots of his approach in American pragmatism and German idealism, till the exploration of some of its most interesting and recent outcomes in pragmatics and semantics. Some of the foundations of Heyes’ radical reasoning seem to be based on a fractional selection of available evidence. Using an ethological perspective, we argue against Heyes’ rapid dismissal of innate cognitive instincts. Heyes’ use of fMRI studies of literacy to claim that culture assembles pieces of mental technology seems an example of incorrect reverse inferences and overlap theories pervasive in cognitive neuroscience.

A lot of attention has recently been devoted to the notion of Trustworthy AI (TAI). However, the very applicability of the notions of trust and trustworthiness to AI systems has been called into question. A purely epistemic account of trust can hardly ground the distinction between trustworthy and merely reliable AI, while it has been argued that insisting on the importance of the trustee’s motivations and goodwill makes the notion of TAI a categorical error. After providing an overview of the (...) debate, we contend that the prevailing views on trust and AI fail to account for the ethically relevant and value-laden aspects of the design and use of AI systems, and we propose an understanding of the notion of TAI that explicitly aims at capturing these aspects. The problems involved in applying trust and trustworthiness to AI systems are overcome by keeping apart trust in AI systems and interpersonal trust. These notions share a conceptual core but should be treated as distinct ones. (shrink)

We present an axiomatic approach for a class of finite, extensive form games of perfect information that makes use of notions like “rationality at a node” and “knowledge at a node.” We distinguish between the game theorist's and the players' own “theory of the game.” The latter is a theory that is sufficient for each player to infer a certain sequence of moves, whereas the former is intended as a justification of such a sequence of moves. While in general the (...) game theorist's theory of the game is not and need not be axiomatized, the players' theory must be an axiomatic one, since we model players as analogous to automatic theorem provers that play the game by inferring (or computing) a sequence of moves. We provide the players with an axiomatic theory sufficient to infer a solution for the game (in our case, the backwards induction equilibrium), and prove its consistency. We then inquire what happens when the theory of the game is augmented with information that a move outside the inferred solution has occurred. We show that a theory that is sufficient for the players to infer a solution and still remains consistent in the face of deviations must be modular. By this we mean that players have distributed knowledge of it. Finally, we show that whenever the theory of the game is group-knowledge (or common knowledge) among the players (i.e., it is the same at each node), a deviation from the solution gives rise to inconsistencies and therefore forces a revision of the theory at later nodes. On the contrary, whenever a theory of the game is modular, a deviation from equilibrium play does not induce a revision of the theory. (shrink)

Famously, Kripke has argued that the central portion of the Philosophical Investigations describes both a skeptical paradox and its skeptical solution. Solving the paradox involves the element of the community, which determines correctness conditions for rule-following behavior. What do such conditions precisely consist of? Is it accurate to say that there is no fact to the matter of rule following? How are the correctness conditions sustained in the community? My answers to these questions revolve around the idea that a rule (...) is followed insofar as a convention is in place. In particular, I consider the game-theoretic definition of convention offered by David Lewis and I show that it illuminates essential aspects of the communitarian understanding of rule-following. The notion of perfect recall in extensive games was introduced by Kuhn (1953), who interpreted it as "equivalent to the assertion that each player is allowed by the rules of the game to remember everything he knew at previous moves and all of his choices at those moves''. We provide a characterization and axiomatization of perfect recall based on two notions of memory: (1) memory of past knowledge and (2) memory of past actions.

Quine’s “New Foundations” (NF) was first presented in Quine [1937] and later on in Quine [1963]. Ernst Specker [1958, 1962], building upon a previous result of Ehrenfeucht and Mostowski [1956], showed that NF is consistent if and only if there is a model of the Theory of Negative (and positive) Types (TNT) with full extensionality that admits of a “shifting automorphism,” but the existence of a such a model remains an open problem.

The article _Anthropological crisis or crisis in moral __status: a philosophy of technology approach to the moral consideration of artificial intelligence_ questions the anthropology of properties commonly assumed in philosophical discussions about the relationship between humans and technologies and the attribution of moral status. By beginning to develop the possible link between the ontology of properties and the anthropological question aptly outlined by that contribution, this short commentary suggests that the adoption of a truly relational or non-proprietary approach in the (...) philosophy of technology seems at once necessary and challenging. For, on the one hand, it represents a response to the demands posed by information technologies; on the other it seems to call into question some of our deeply ingrained habits of thought. (shrink)

The logical foundations of game-theoretic solution concepts have so far been explored within the con¯nes of epistemic logic. In this paper we turn to a di®erent branch of modal logic, namely temporal logic, and propose to view the solution of a game as a complete prediction about future play. The branching time framework is extended by adding agents and by de¯ning the notion of prediction.
